SAP AG of Germany is paying $120 million to Oracle Corp in return for a promise by the U.S company not to look for healing damages in its lawsuit against SAP for the theft of software. When the HP refused a court order for Leo Apotheker to testify in the case, the legal drama increased. Leo Apotheker is the new chief executive of HP and he is former CEO of SAP.

This news was released by some sources but on condition of anonymity because they were ordered to keep the matter quiet by the judge. SAP reported profit of $1 billion in the recent quarter, it has admitted its mistake in the three and one-half year case, also accepted the responsibility and close down its subsidiary, TomorrowNow. TomorrowNow downloaded millions of files impropertly from the customer service website of Oracle.

The two companies are fighting on the redeeming damages which SAP will have to pay, it varies from tens of millions to billions of dollars. These compensative damages are allocated for particular losses. The agreement requires final approval in Oakland by U.S district judge. $120 million is a huge amount for legal fees, but SAP has to do this.
